§ 12.04.210. Prohibited locations.

  • Driveway approaches are prohibited in the following locations:

    A.

    At street intersections no portion of any driveway approach, including end slopes, shall be permitted between the limits of the intersection of the prolonged property lines and the curb.

    B.

    Along the street no driveway approach will be allowed unless a permanent asphalt, concrete or impervious material driveway previously existed or where building plans have been finalized to build a permanent parking structure, pad, carport or parking pad conforming to zoning regulations. Driveways shall be located at the discretion of and by the approval of the director of public works, so as to result in no undue interference with or hazard to free movement of normal traffic or interference with the placement and proper function of highway signs, signals, lighting or other devices that affect traffic operation.

    C.

    Where barriers exist which do not allow a driveway grade of less than ten percent, driveway grades on private property should comply with any zoning requirements, but the grades should not exceed ten percent for reasons of safety and access.

    D.

    No curb cut opening shall be allowed within thirty (30) feet of a crosswalk in a residential zone or within fifteen (15) feet of a crosswalk in a commercial zone.

    E.

    Where demonstrated hardships can be shown, the zoning board of adjustments committee may issue variances allowing individual driveway approaches or curb cuts in prohibited locations.
