§ 12.08.100. Obligation of applicant.

    An applicant for a permit to excavate any surface within public right-of-way of the city shall within fifteen (15) calendar days of issuance of such permit repair and complete the surface of such excavation. Extension of time may be granted by the public works director or designated agent upon showing of justifiable cause by the permittee, such extension when granted must be in writing.

    B.

    If inspection of a project while under construction finds construction methods being practiced not conforming to Sections 12.08.020 through 12.08.090, a correction notice will be issued by the public works director or designated agent listing items of procedures not meeting requirements of the above sections. Three calendar days' action is required of permittee to bring items listed on correction notice into conformity with the above sections. If corrections listed on notice are not brought to conformity with the above sections in the specified time period, a stop work order for the project will be issued. Work on the project shall only resume after a meeting with the permittee, the public works director and the agent who issued the stop work order. If project is not brought to conform with the above sections, the public works director or designated agent shall cause the excavation to be placed in a condition that does not meet the requirements of the above sections. Costs shall be against the applicant's bond under Section 12.08.010, with legal action against the applicant's business.
