§ 17.112.030. Nonconforming structures.

  • Where a lawful structure exists on the effective date of adoption or amendment of the ordinance codified in this chapter but becomes nonconforming under the terms of this chapter, such structure may be continued, provided it remains otherwise lawful, subject to the following provisions;

    A.

    A nonconforming structure may not be enlarged or altered in a way which increases its nonconformity, but any structure or portion thereof may be altered to decrease its nonconformity.

    B.

    Should a nonconforming structure or nonconforming portion of structure be damaged or destroyed by any means to an extent of more than fifty (50) percent of its square footage at the time of such damage or destruction, it shall not be reconstructed except in compliance with the provisions of the ordinance codified in this chapter.

    C.

    Should a nonconforming structure be moved for any reason for any distance whatsoever, it shall thereafter conform to the regulations for the district in which it is located.

    D.

    Nothing in this chapter shall be deemed to prevent the routine repair and maintenance of a nonconforming structure.

    E.

    Nothing in this chapter shall be deemed to prevent the strengthening or restoring to a safe condition of any building or part thereof declared to be unsafe by any authorized official charged with protecting the public safety.
