  • The intent of this chapter is to establish procedures and criteria to authorize special use permits. "Special use" means a use which because of its unique or varying characteristics, cannot properly be classified as an allowed use in a particular zone district. Special uses are contingent uses which may or may not be appropriate in a particular location depending on the nature of the proposed special use, its relationship to the surrounding land uses and its impacts on traffic capacities, potential environmental effects, compatibility with the neighborhood, and conformance to adopted policies, guidelines, plans and regulations of the City of Hamilton. Prior to establishment of a special use, a special use permit must be approved or approved with conditions deemed necessary and appropriate solely by the City of Hamilton City Council.
