§ 5.04.020. Definitions.

  • For the purposes of this chapter, the following words shall have these meanings:

    "Business" means any occupation, vocation, pursuit, trade, industry, profession, or commercial activity of any kind, carried on for purposes of economic benefit or profit or engaged in for livelihood or gain.

    "City" means the City of Hamilton, County of Ravalli, State of Montana.

    "Home occupation' means any for-profit activity carried on in a residential district within the city limits as a use subordinate to the primary use, including as further defined in Chapter 17.108.

    "Itinerant vendor" means any person engaged or employed in any business of retailing to consumers by going from consumer to consumer, either on the streets or to their places of residence or employment, and there soliciting, selling, or offering to sell, or exhibiting for sale, (by sample, by catalogue, or otherwise), or taking orders for future delivery of any goods, wares or merchandise, or for services to be performed in the future.

    "Nonprofit organization" means any religious, charitable, social, educational, or civic group which does not distribute profits or dividends to the members thereof and where profit is not their primary objective.

    "Permission" means the written approval to operate a transient vendor business on private property.

    "Person" means a corporation, partnership, company, vendor, association, or society as well as a natural person and the agents and representatives thereof.

    "Retail business" means a business which sells goods, services, or other articles of trade in small amounts directly to the ultimate consumer.

    "Resident wholesale/retail business" means a person, firm, or corporation with a fixed premises or with a legal address within the city.

    "Sanitarian" means the Ravalli County Sanitarian.

    "Sanitarian permit" means the permit issued by the Ravalli County Sanitarian for food services.

    "Transient vendor" is any person engaged in the sale or distribution of goods, food or services, whether or not for profit, from nonpermanent stands, structures, display racks or from vehicles situated on the public property or in commercial parking lots. Any person so engaged shall be considered a transient vendor regardless of the operation of such activity and regardless of whether the person operates a business at a permanent location within the city.

    "Wholesale business" means a business which sells goods, services, or other articles of trade in large quantities usually for resale by retail businesses.

    "Year" for general city business license purposes, means a period of time of twelve (12) months commencing each year on January 1 st and ending the last day of December of the same year.
